A Lease will vary between the different states and it will lay out all of the Legal Conditions that the Rental will operate under. Be aware that it is a Legal Document and it is binding on both sides once signed and exchanged. You will receive 2/3 copies, sign all copies and return 1 to the rental agent. The agent will talk you through the process and answer any queries. Don’t be put off by it; the Lease is securing your holiday rental.
A typical Vacation Rental Lease (self catering agreement) will include the following:
- Who the Holiday Lease Agreement is between – The Tenant and The Landlord both names and addresses.
Date of Lease.
- Address of rental property, length of rental with start and finish dates and check-in and check-out times.
- The Tenant agrees the he is renting the property for vacation/recreational use under the conditions of this lease.
- Amount of Rent to pay including taxes, when and how the rent has to be paid. This is usually in 2 instalments; first 50% of rent within 10 days of reservation being made with an additional reservation fee (from $50 ) second instalment with Refundable Security Deposit up to 2 months before you arrive.
- Outline of Refundable Security Deposit or Property Damage Protection Fee and how it works.
- You may be offered Cancellation Insurance. If you are coming from outside USA, this should be included in your Travel Insurance.
- The maximum number of people allowed to occupy the property.
- Tenant’s responsibilities’ for any damages except normal wear and tear.
- Landlord’s rights for evicting a defaulting Tenant.
- The Right of entry conditions by the Landlord or Agent
- Conditions where the house has become unfit for habitation, by fire or other causes.
- Landlord supply of equipment and furnishings.
- Use of landline telephone.
- The Tenant agrees to leave the house clean when leaving.
- Whether Bed Linens and Towels are supplied or not.
- Acceptance of the Condition of the House by the Tenant when rented without prior inspection.
- Landlord Liability Disclaimer of Tenant or guests use or misuse of the property.
